Mr Saggar also wrote an impassioned plea reaching out to other aggrieved buyers on behalf of Rahejas even making ridiculous statements like "Raheja has given us a 15m road, which I have driven on that road, which is better than 24m." What ??? By the way, the 24m road that Mr Saggar compares with the 15m road that "Raheja has given" them does not even exist. There is also a pretty solid case in the National Consumer Disputes Redressal Commission NCDRC filed by 130 Raheja Vedaanta buyers, of which some are now expected to follow Joe & Raj into the arms of Raheja Developers.
Mr Joe Saggar was pretty aggressive in raising the Environment Issues, and also about the 24 m road, and of the fire violations, etc ... and suddenly he forgot all those and became brand ambassador of Raheja Developers. How can you explain this switch.
And the fact that he jumped on a flight from UK (at his own cost?) at a day's notice to attend the press conference and take possession of legally defective apartment?

Their attempt to followup on the Supreme Court observation that Environment Violations are not to be condoned routinely, and construction should not progress unless the clearances are in place, is missing the MAIN POINT.
In He said/ She said reporting, and with little application of their mind and knowledge over the many years of reporting, they have just reported the false statement by builders that building plans are not approved till the environment clearances are not in place.
FIRSTLY, some builders start construction without approval of building plans, without the receipt of EC, and that is illegal.
SECONDLY, majority of the violations take place after the initial building plan is approved and EC obtained. The building plan is then REVISED, and THEN THE EC is not obtained !!! And almost every builder is busy revising plans.
And in the case of Raheja Developers, projects in Sectors 108 & 109, they did construction without EC on licence 14 of 2011 (there is sufficient photographic proof no matter how much Navin Raheja denies it), revised the plans in both projects and did not get the Environment Clearances for the REVISED PLANS. Further, the EC expired around April/ May 2014 for both projects and Rahejas did not even bother to apply for it till a year later !!
WHY? Because by revising the plans they have increased apartments from approx 450 to 700 in Atharva. They also increased the number of apartments similarly in another project called NAVODAYA. Because, by increasing the number of apartments they increased their profits. It is not routine violations just because of tardy paperwork - but a well planned out financial crime. The hope is that as new buyers become third-party in this dispute, the EC violations will be condoned post-facto.
Raheja, has also obtained the Occupation Certificates on expired EC's, in connivance with bureaucrats like Anurag Rastogi & IS Kashyap to illegally avail tax benefits under 80 IB. They allow have robbed the National Treasury to the tine of hundreds of crores.
And remember that all these violations are always to the detriment of the buyers. These are not victimless crimes, and there is always a crime motive.

NARDECO “REGRETS” UNITECH DIRECTORS’ JAIL
New Delhi, 14th January 2016: National Real Estate Development Council (NARDECO) today regretted the arrest of UNITECH directors being jailed for a day before they got bail and reiterates its request to the government to strengthen the housing sector governance foolproof so that developers must strive for quality construction and delivery by the deadlines.
NARDECO President Mr. Parveen Jain said some breathing space must be given to developers who are not able to give timely delivery of flats or office space due to unforeseen reasons which include labour problems, irregularities in supply even leading to non-availability of raw materials at times, policy and guidelines from government from time to time, e.g., limitations to the use of underground water, banning of concrete from the crushers and challenges rising from sand querying, delays relating to completion of local formalities, etc. How beneficial it could have been in case a Single Window Clearance Mechanism with strict timelines as suggested by NAREDCO was implemented, an embarrassing situation like this could have been avoided.
To curb irregularities, delayed delivery of flats and office space, the Central Government has proposed the Real Estate Bill which is pending in Parliament. The passage of Bill needs to be hastened so that a governance system is in place which will help developers to manage their plan of action, Mr Jain said.
The sentiments related to buying real estate whether housing or commercial is very poor and on top of it developers are facing the brunt due to limited funding.
“Real Estate developers are not criminals, rather they are partners in nation building. Court proceedings are a strong message and some reasonable time to adhere must be awarded before penalising. This should be enough”, he said.

Navin Raheja of Raheja Develoeprs is a Cheat and used the same cheques in 2 Sale deeds, stating different amounts, and FIVE (5) years after the were issued !!! And the cheques were issued not as a sale consideration, but as refundable and non-refundable security in a Collaboration Deal.

Tax Chor Mr Navin Raheja of Raheja Developers is in a unique position - In Documents Submitted at Honorable Supreme Court in 2014 the builder has stated projects to be completed (and OCCUPATION CERTIFICATE is Claimed to be the SAME AS COMPLETION CERTIFICATE !!) while in reports to Ministry of Environment & Forests (MOEF) the builder is disclosing that the projects are INCOMPLETE (still in construction phase) as late as May 2015.
This whole false document submission at the Honorable Supreme Court was to ILLEGALLY claim 100% tax benefit on the profits earned under Section 801B (10) by claiming that the projects were completed in 2014. While the reality that the projects like Atharva, Vedaanta, & Navodaya are still INCOMPLETE.
And in helping pull of this fraud are babus in Haryana like Shri Anurag Rastogi, IAS, and Shri IS Kashyap, Fire Officer in Sector 29 of Gurgaon.
Mr Anurag Rastogi, IAS, http://harenvironment.gov.in/html/annexure-a.htm has not responded to over 9 reminders asking him as to why Occupation Certificates were illegally given to projects of Raheja Developers - namely, Vedaanta & Atharva.
Even copies to the Principal Secretary of CM of Haryana and CM Office have not convinced Mr Rastogi to explain as to why Occupation Certificates were prematurely given to benefit Mr Navin Raheja & Raheja Developers to the tune of hundreds of crore Rupees.
Navin Raheja of Raheja Developers is a flat out LIAR. He claims that there was no sealing in the Sector 109 project of Atharva. LIES. The 0.8 acres that comes under Licence 14 of 2011 does not eaven have Environmental Clearance and yet Rahejas were constructing on it.
Further, the ex DG TCP, Mr Anurag Rastogi, IAS even gave Occupation Certificate on this 0.8 acre piece of land, even though Rahejas had not even applied for Environmental Clearance for it. And, incidentally, the Environmental Clearance of 14.812 acres under licence 257 of 2007 had also expired - YET MR ANURAG RASTOGI, IAS gave it Occupation Certificate.
Navin Raheja lies blatantly, and it needs to be seen how long the gullible press (Sarkar humne aapka namak khaya hai) turns the other way. Soon, the truth will be apparent to all.

Background of cases
17 buyers filled three cases in NCDRC for fraudulent practices adopted by M/S MVL Limited, A gurgaon based builder, in their project MVL Coral, Bhiwadi, Rajasthan . M/s MVL Limited floated a scheme in the year 2006 and aggressively marketed the said project promising high living luxury apartments, specially designed Swimming Pool, 24 hour power back up, Modular Kitchen, Covered Car Parking, Garden, Play Area, Security Club house, Rain Water Harvesting, Wifi Internet, Gymnasium etc. The project was planned with five towers namely Avenue-1,2,3,4 and 5. Out of 5 towers, only tower no. 5 has been constructed at site as per approved layout plan. The numbering and layout plans of all other towers were changed for unprecedented gains by the builder. 3 complainants had booked in tower-5 and all others in other towers. MVL Limited could not obtain mandatory occupancy certificate for the said project.
In its order, the NCDRC on 7-12-2015 said 3 buyers of tower-5 will take possession. MVL Limited is directed to furnish the occupation certificate, within 9 months from date of orders, as agreed, otherwise, it will carry additional penalty in the sum of Rs.2,000/ per day for each of the complainants, after the expiry of said 9 months. There was a delay in providing possession in the premises in dispute. Consequently, they be paid penalty of delayed possession @ 15% per year, till the possession is given. MVL Limited is also directed to provide covered car parking, club membership, power backup, park facing flat, wherever applicable and corner flat, wherever is applicable, as mentioned in the agreement, within a period of 9 months, as already ordered, otherwise, it will return the entire amounts paid by the complainants, along with interest @15% p.a. from the date of receipt of the money, till realization.
For all other complainants commission noted MVL Ltd. had changed its original plans and increased the number of floors, flooring area, ratio and density per acre. It has caused inordinate delay in completion of said projects. It has changed zoning plans, usage pattern, super area, carpet area and alteration of structures.
This is an indisputable fact that the MVL Limited, of its own accord, arbitrarily and despotically, without seeking the consent of the allottees, has changed the tower number. This is deficiency on its part. The consumers cannot be compelled to accept the flats according to the sweet choice of the builder. The choice of builder cannot be imposed upon the consumers. It would be worst kind of highhandedness on the part of the builder.
Consequently, all other complainants are entitled of refund of money. All the remaining complainants shall be refunded the money that they had paid with interest @15% p.a from the date they paid till realization.
All the complainants are entitled to costs in the sum of Rs.25,000/each complainant.

I booked a property in Year 2009 with Indiabulls Real Estate. The name of the property is Indiabulls Centrum Park, Sector 103, Gurgaon.
During booking, the salable area was 1350 Sqft . The property was also advertised as the property with lowest loading. (Enclosing advertisement)
In 2010 when the agreement was signed, the builder increased the super area to 1600 sqft (mentioned in the agreement).
Now when the complex got over (in 6+ years – 2009 till 2015), the builder has now changed the super area to 1700 Sq ft with no change in builtup area (from the original 1350 sq ft salable area)
has paid back the charges of late construction only till the time when they
applied for OC. The OC was issued recently which as per builder is not their
flaw. It is flaw of Haryana Govt.
The increase in salable area from 1350 to 1700 is unjustified. This is cheating with the consumer.
I need help in forwarding this to Chief Minister’s newly formed “Allottees Grievances Refressal Forum”.

The builder has started abusing us.. and forcing to sign agreement of additional 100 Sq ft which is not legal. In case we dont sign, they are telling us that they will cancel the booking and agreement.
@fundoo You can go to DC TL Satya Prakash's office in Mini Secretariat. There you will also find the CM Window where you can submit your complaint, and get a receiving.
Further, for the next Allottees Grievances Refressal Forum Meeting, you can find out the date of the next meeting, submit your complaint with all the supporting documents, well in time - so that the builder can be informed and will ave to be present in the next meeting. The Chairman of the AGRF is DC Satyaprakash.
It will be more effective if you can get some more buyers together, and approach as a group. Also, take the time to study the relevant policies & documents, and file RTIs, to collect all relevant information about violations/ illegalities in the the Centrum Park Project.
Do note that purely contractual issues, i.e disputes about what was promised and what is being given in the Builder-Buyers Agreement , are not in the scope of the AGRF - they are better handled in the civil or consumer courts. For violations, illegalities, cheating, fraud etc you can give the AGRF a shot.
Our advice is to try to approach and work together as a group .....
Unitech Group seems to be another builder that is running into big time problems. The current status of their various projects, from a June 2015 company presentation, is given below.
Thanks to their pathetic performance, the National Consumer Commission has given some landmark judgments awarding 12% to 18% compensation to buyers (rather than the meager Rs 5 to 13 psf per month). These judgments will be used as precedents to get similar orders passed on other tardy builders.

In a related update, Raheja Developers have paid Rs 28 lakhs in interest on the IBMS Security that it is still holding in their Raheja Atlantis project. The cheque was handed over to the RAAOA on December 18, 2014. The Prime Minister's Office has sent a letter directing the Chief Secretary of Haryana to conduct an investigation into the complaints of "Raheja Atharva" buyers, and report back expeditiously to the PMO.
